Mr. Pritam Roy ....Amicus Report filed on behalf of the State is taken on record. It appears that the alleged victim was notified about the date of hearing.
It is submitted by the Amicus that the alleged victim is present in Court.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. He is a friend of the victim's husband. The victim's husband had taken a loan of Rs. 1 lakh from him. When demand for repayment was made, the present false FIR was registered. There is a delay of about eight days in lodging the FIR.
Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He relies on the statement of the victim recorded before the learned Magistrate, the statements made before the police authorities and the medico-legal examination
report. The victim had confided about the incident to the doctor who examined her. Apart from the allegations of rape, there is a further allegation that the petitioner had taken objectionable photographs of the alleged victim and circulated the same amongst his friends. Investigation is going on.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
