Re : CRAN 1 of 2024 Having regard to the report so submitted by the Police Authorities and the reasons so assigned, I am of the view that the limited scope for which there has been delay in preferring the revisional application be condoned and the revisional application be considered on merit. Accordingly, the application being CRAN 1 of 2024 is allowed. Report so submitted by the learned Additional Public Prosecutor appearing for the State be kept with the record. It reflects from the ordersheet dated 15-12-2023 that the execution relating to the warrant of arrest issued against the petitioner was pending. Record reflects that the some of the witnesses have been examined and thereafter the petitioner stopped coming to court. There are three cases pending against the petitioner. However, as the warrant of arrest was pending since 18-03-2024 at least which is reflected from the records, the execution return of the warrant of arrest be stayed till 30th May, 2024.
The petitioner would appear before the learned Additional District and Sessions Judge, Fast Track Court-II, Calcutta and furnish fresh bonds. If the petitioner appears and surrenders by 30th May, 2024, the learned trial court would recall the warrant of arrest so issued. However, if the petitioner do not appear or surrender by 30th May, 2024, the learned trial court on the next working day would be at liberty to exhaust harsher process of law, if already not issued, by adhering to section 82 of the Code of Criminal Procedure.
With the aforesaid observations, the revisional application being CRR 1484 of 2024 is disposed of.
