In the matter of:- Smt. Tulsi Rani Saha Mr. Subir Ganguly Mr. Durga Prasad Dutta Mr. Sumanta Ganguly ...for the petitioner Mr. Rudradipta Nandy Ms. S. Saha ..for the op Learned counsel who had been engaged by the petitioner to move this application submits that the petitioner passed away in the meantime. Although one of the sons had earlier prayed for substitution, he is actually not interested to proceed with the matter. He would have not pressed the application had the substitution been allowed.

A copy of the death certificate, as filed in Court, is taken on record.

A copy of the written instruction of the said applicant, as filed in Court, is also taken on record. Learned counsel submits that in view of the same, the revisional application may be dismissed as having become infructuous.

In view of the above, the revisional application is

dismissed as having become infructuous and the connected application stands dismissed accordingly. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
