The petitioner claims himself to be the recorded owner of plot no.69, J.L. No.338, Mouza-Jhariya, Block-Jhargram, District-Jhargram.

The petitioner alleges that taking advantage of his prolonged absence, respondent nos.6 to 9 have occupied the said land and constructed a building on it without obtaining any sanctioned plan from the Jhargram Municipality.

The petitioner has made a representation before the Municipality on September 20, 2023, but the said representation has not yielded any result.

This Court is not inclined to delve into the question of ownership. However, respondent nos.6 to 9 cannot raise any construction on the said plot without any sanctioned plan from the Jhargram Municipality.

In view of the above facts, I dispose of this writ petition with a direction upon Jhargram Municipality to consider the representation dated September 20, 2023 filed by the petitioner in accordance with law within a period of three months from the date of communication of this order with an opportunity of hearing to the petitioner as well as respondent nos.6 to 9.

Accordingly, WPA 9990 of 2024 is disposed of. Urgent certified photocopy of this order, if applied for, be supplied to the parties on compliance of usual legal formalities.
