Petitioner is in custody for more than a year. He submits there is no progress in the matter since rejection of bail by this court. He renews his bail prayer.

Learned lawyer for the State opposes the bail prayer. He submits petitioner had stabbed the victim.

We have considered the materials on record. Bail prayer of the petitioner was rejected earlier on merits in September 2023. However, there is no progress in the matter since then. Offences, if proved, would not attract mandatory life imprisonment. There is no chance of absconding.

Under such circumstances, we are inclined to grant bail to the petitioner.

Accordingly, the petitioner be released on bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, one of whom must be local to the satisfaction of the learned ACJM Krishnanagar Nadia on condition that the petitioner shall appear before the trial court on every date of hearing and shall not Signed By :

intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event he fails to do so or resorts to dilatory tactics and delay the trial, trial court shall be at liberty to cancel his bail without reference to this court.

The application being CRM (DB) 1117 of 2024 is disposed of.
