By consent of the parties, the order dated 2nd September, 2025 stands corrected to reflect the correct premises number i.e. 75 Ghoshpara, P.O. - Makhla, P.S. - Uttarpara, District : Hooghly, Pin - 712 245 instead of 46/1, Ghosh Para Lane, P.O. - Makhla, P.S. Uttarpara, Disrict - Hooghly, Pin - 712245.

The grievance of the petitioners is primarily directed against the unauthorized and illegal construction at the above premises. It is fairly admitted by all the parties that during pendency of this writ petition, the concerned municipality being the Uttarpara-Kotrong Municipality has passed an order for demolition dated 2nd September, 2025.

In view of the above, nothing survives in this writ

petition. The respondent authorities have been taken necessary steps in the matter.

WPA 9388 of 2025 alongwith the connected interlocutory application being CAN 1 of 2025 stands disposed of.

Liberty is granted to both the petitioners and the private respondent to take necessary steps, in accordance with law, in so far as the demolition order dated 2nd September, 2025 is concerned.

A copy of the order dated 2nd September, 2025 be kept with the records.

It is submitted on behalf of the private respondent that there has been no hearing prior to passing of the order of demolition. This submission is vehemently opposed by the petitioners as well as the Municipality. There shall, however, be no order as to costs. Urgent Photostat certified copy of the order if applied for, be made over to the parties as expeditiously as possible.
