Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner has referred to an order of the year 2009 passed by the Chief Executive Officer, Board of Wakfs, West Bengal.

Thereafter communication to the Commissioner of Police was made in the year 2018. Having regard to the period of nine years in between having passed, I am of the view that in 2025, seven years hence the Board has to freshly apply to the police authorities, if they intend to implement any previous orders.

Accordingly, such liberty is granted to Mutawalli or the Board of Wakfs or its authorised officer, if there is no change of circumstances in accordance with the provisions of the statute. The police authorities would render necessary assistance, if so called upon.

With the aforesaid observations, the writ petition being WPA 7653 of 2018 is disposed of.

Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
