CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1434 of 2011 In Re: An application under Section 482 of the Code of Criminal Procedure.

The revisional application was preferred challenging the order dated 24.03.2011 passed by the learned Additional Chief Judicial Magistrate, Siliguri in Misc. Petition no. 23 of 2011 under Section 156(3) of the Code of Criminal Procedure, as well as the FIR registered being Siliguri PS case no. 204/11 dated 08.04.2011 under Section 420/120B of Indian Penal Code.

Records of the revisional application reflected that a Coordinate Bench of this Court was pleased to direct that the investigation of the case would proceed but no report in final form should be submitted without the leave of this Court as also direct that no coercive measure was taken by the State.

Having regard to the period it has lapsed in the impugned attempt, presumably the investigation has been concluded. No information has been furnished before this Court so far as the progress of the investigation is concerned.

As such the investigating agency is directed to submit their report under Section 173 of the Code of Criminal Procedure before the jurisdictional Court.

Having regard to the above no interference is called for. Accordingly, CRR 1434 of 2011 is dismissed. Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
