CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1438 of 2011 In Re: An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The revisional application has been preferred against the order dated 31.01.2011 passed by the learned Additional Sessions Judge, Katwa, in Criminal Revision no. 42 of 2009 wherein the learned Sessions Judge being the revisional Court was pleased to dismiss the revisional application and affirmed the order dated 27.07.2009 passed by the learned Judicial Magistrate, 2nd Court, Katwa in Misc. Case no. 119/05.

The order of the learned Sessions Court reflects that the learned Magistrate was pleased to award the a sum of Rs.2000/- per month to the wife and Rs.1000/- per month to the minor daughter, aggregating to the sum by Rs.3000/- per month paid by the present petitioner.

Having regard to the quantum which was awarded by way of maintenance I am of the view that no interference is called for at this stage after more than 10 years. Thus, CRR 1438 of 2011 is dismissed.

Interim order, if any, is hereby vacated.
