Heard the learned Advocates for the parties.

We have considered the materials on record. 50 ltrs. of codeine phosphate was recovered from the petitioner. He does not stand on the same footing with co-accused from whom no narcotics was recovered and had been granted pre-arrest bail.

Keeping in mind the aforesaid circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
