Re : An application under Article 227 of the Constitution of India in connection with Complaint Case No. 3014/2017 under S.138 of the N. I. Act. Mr. Sambhunath De ....for the petitioner.

The present complaint case was filed under Section 138 of the N. I. Act in the year 2017 before the learned Additional Chief Judicial Magistrate, Bidhannagar. The order dated 1.3.21 reflects that the process under Section 251 of the Code of Criminal Procedure was completed, but the subsequent orders also reflect that the date is being fixed for plea.

Having considered the fact that after the process was completed date was not fixed for evidence, I direct the learned trial court to fix at least one date in a month for the purposes of the present case so that the trial can be concluded at least by 31st January, 2024.

With the aforesaid observations, the present revisional application being CRR 1406 of 2023 is disposed of. Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this
