(VIA VIDEO CONFERENCE) Mrs. Chaitali Mukhopadhyay ...for the petitioners Mr. Probal Mukherjee Mrs. Sujata Mukherjee ....for the KPT The grievance of the petitioner is directed against issuing a direct lease in the name of the petitioner in respect of the land situated at 103-A, Foreshore Road, Howrah.

Mr. Mukherjee, Senior Advocate, appearing on behalf of the respondents no. 2, 3 and 4 submits that the proceeding under the Public Premises Eviction Act had been initiated against the original lessor and an eviction order has already been passed.

This petition has been pending since the year 2007. In view of the submission made on behalf of the respondents no. 2, 3 and 4 I find that the petitioner has been unable to demonstrate any enforceable and legal right in respect of the aforesaid premises.

Accordingly, WPA No. 7383 of 2007 is dismissed. There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
