As none appears on behalf of the State, Mr.

Swapan Banerjee, learned AGP along with Mr.

Akash Dutta, learned advocate is directed to represent the State. Their appointment may be regularised by the concerned authorities.

The petitioner is granted liberty to approach the jurisdictional Magistrate to address her grievance particularly, with regard to the investigating agency not having conducted investigation under Section 3 of the West Bengal Protection of Interest of Depositors in Financial Establishments Act, 2013. In case such an application is advanced before the learned Magistrate, learned Magistrate would in the background of the legal proposition laid down as also the object of the said Act, pass necessary directions upon the investigating officer in the background of the facts of the present case.

With the aforesaid observations, the writ petition being WPA 9128 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
