The learned advocate representing the Board submits that the petitioners did not fulfill the minimum eligibility criteria for recruitment and accordingly their applications were not taken up for consideration by the Board. The petitioners were treated as untrained candidates as they did not possess the D.El.ED qualification.

As it appears from the submissions made on behalf of both the parties that the petitioners did not possess the requisite qualification for appointment

accordingly their candidatures could not have been taken up for consideration for the purpose of giving appointment to them. The Board does not have the authority to appoint any candidate who does not possess the minimum eligibility criteria for appointment.

No relief can be granted to the petitioners in the instant case.

The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
