29.09.2020 D/L No.30 Court No.24 s.biswas WPA 6886 of 2020 With CAN 1/2020 (Old No. CAN 5963 of 2020) Sujan Talukdar Vs.

State of West Bengal & Ors.

(Through Video Conference) Mr. Md. Younush Mondal ... ... for the petitioner CAN 5963 of 2020 is an application for urgent hearing of the writ petition and is disposed of by taking up the writ petition for consideration.

None appears for the State.

The petitioner complains that despite the Panchayat giving permission to erect a mobile tower, due to the disturbances caused by the local people, the petitioner is unable to do so. Complaints to the police have not evoked any response.

A person with requisite permission is entitled to construct in accordance with the sanction standing in his favour. Since the petitioner has requisite permission, in the facts of the present case, it would be appropriate to permit the petitioner to make the construction in accordance with law. The police will ensure that no breach of peace occurs at the locale during the construction being carried out by the petitioner.

WPA 6886 of 2020 is disposed of without any order as to costs.
