Siddiqui ... for the State Mr. Susovan Sengupta Ms. Supriya Dubey ... for Food & Supplies Department The grievance of the petitioner is that even though his application has been considered and he has been found to be eligible and has been recommended for incorporating the name of the petitioner no.2 as partner in the business, the District Controller is not following up the matter diligently. The petitioner was communicated about their eligibility for being appointed as partner in the business by Sub-Divisional Controller (Food & Supplies) Jhalda by communicating memo dated 25th August, 2021. The said communication mentions that the case was enquired by the area Inspector (F&S), Jhalda and it was established that the petitioner no.2 is the son of the petitioner no.1 and belongs to the 'family members' and accordingly

found eligible to be incorporated as partner in the business.

Presently the District Controller is liable to take necessary follow up steps to implement the observations given by the Sub-Divisional Controller (Food & Supplies), Jhalda.

In view of the above, the instant writ petition is disposed of by directing the concerned authority to take necessary steps for implementing the direction given by the Sub-Divisional Controller (Food & Supplies), Jhalda as communicated to the petitioner by a communicating memo dated 25th August, 2021.

Necessary positive steps shall be taken to comply the direction at the earliest but positively within a period of twelve weeks from the date of communication of this order.

The petitioner is directed to forward a copy of the communicating memo dated 25th August, 2021 to the respondents at the time of communicating the order of this court.

The writ petition stands disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
