Pursuant to the leave granted by the Hon'ble Supreme Court in Petition for Special Leave to Appeal No. 3916 of 2021 on March 8, 2021, the review petition being R.V.W. 74 of 2021 has been filed by the State of West Bengal.

It appears from the order of the Hon'ble Supreme Court passed in the special leave petition, the State of West Bengal had contended that there are no rules, regulations or scheme for general provident fund cum pension for the employees of the West Bengal Minority Commission. It was further contended that there were also no rules for gratuity cum pension for the employees working in the West Bengal Minority Commission.

It is clear that till date no rules have been framed for general provident fund cum pension for the employees of the West Bengal Minority Commission. The question whether the State could be directed to complete the said process and to extend such benefits to the employees of the West Bengal Minority Commission needs to be decided.

On such consideration, we are of the opinion that the order passed by us needs to be reviewed. We, therefore, recall our order dated March 2, 2020 and direct the appeal to be listed before

the regular bench for consideration afresh.

The application for review and connected applications relating thereto stand allowed.

In view of the order, as aforesaid, contempt does not lie against the order dated March 2, 2020. As such C.P.A.N. 284 of 2021 stands dismissed as infructuous.

There will be no order as to costs.
