Learned advocate appearing for the petitioner submits that the petitioner was arrested on 05.02.2026 and since then he is in custody. Learned advocate submits that petitioner is similarly placed as the other accused namely, Rishabh Chauhan @ Rishabh Chowhan who has been granted bail in CRM (R) 29 of 2026. Mr. Amajit De and Mr. Somnath Adhikary, learned advocates appear for the State. Their appointments may be regularized by the concerned authorities.

Learned advocate for the State opposes the prayer for bail produces the case records. It is seen that the victim received Whatsapp call and callers introduced themselves as high ranking police officials of Mumbai Police who were investigating a money laundering case. On the basis of threats by the accused persons a sum of Rs.1,55,00,000/- were transferred by way of four separate transfers, mostly by way of RTGS.

Records of the case reflect that it is the present petitioner on whose instructions the other accused acted.

The memo of evidence submitted by the police authorities reveal that petitioner is also accused in Faridabad Cyber Crime Police Station case no. 167/2025 dated 25.06.2025 and Timarpur PS (North Delhi) case no. 383/2025 dated 16.08.2025. Petitioner is a habitual offender in respect of the cyber offences, the present is a case of digital arrest.

Having regard to the conduct of the petitioner and criminal antecedents, I am not inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner in CRM (R) 46 of 2026 is rejected.
