Learned advocate appearing for the petitioner submits that the petitioner is sought to be proceeded against on the basis of the circumstantial evidence. He highlights the period of custody of the petitioner. He submits that there is hardly any possibility by the trial concluding any time soon.

Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary. There is hardly any material change in circumstances subsequent to the earlier order of rejection. The Court is informed that the trial is in progress. The last date was on May 18, 2022 for the purpose of recording the evidence of the prosecution. In the facts of the present case, it would be appropriate to request the trial Judge to invoke the provisions of Section 309 of the Code of Criminal Procedure, fix consecutive dates of trial and not to grant any unnecessary adjournment to any of the parties. CRM (DB) 1326 of 2022 is rejected.
