Pursuant to the earlier direction the Inspector-in14.05.2025 Court No. 35 Item No.2 Rakib Charge of Md. Bazar Police Station, Birbhum has submitted a report. A physical field enquiry was made in presence of the owner of the plots which has been referred to in the writ petition. It is reflected in the report that one Biswajit Mondal was digging a pond at the area for fishery after paying adequate fees and maintaining all legal norms of the Government. Specifically it has been stated that no mining activities have been carried out in the plots referred in the writ petition.

In view of the grievance addressed in the writ petition, I am of the opinion if the factual circumstances are such that the petitioner has material in his possession he would be at liberty to approach the jurisdictional Magistrate by invoking the relevant provisions of law.

Having considered the report so submitted and the submissions advanced on behalf of the State, further pendency of the writ petition is unwarranted. Accordingly, WPA 9300 of 2025 is disposed of. Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
