Learned advocate appearing for the petitioner submits that the subject-matter of the case relates to alleged recovery of 20 bottles of Phensedyl; petitioner has been implicated on the basis of statement of co-accused and he is in custody for 52 days. As charge-sheet has already been submitted, petitioner prays for bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail.

Records of the case reflect that prosecution intends to rely upon 11 witnesses in order to prove its case and till date, charges have not been framed. Having considered the complicity of the present petitioner and the fact that other accused person has been granted bail on 02.04.2026 in CRM(NDPS) 543 of 2026, I am inclined to release the petitioner viz., Samiullah Momin @ Momin on bail on the

same terms and conditions as were imposed on the other accused in CRM(NDPS) 543 of 2026.

As such, the prayer for bail of the petitioner is allowed. The application for bail, being CRM (NDPS) 803 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
