Petitioner has approached this Court being aggrieved by non-consideration of the representation made to the police authorities including the superior police authorities. Petitioner apprehends that she may be subjected to unforeseen circumstances because of the overt acts which may be at the behest of her husband.

State has submitted a report. Report reflects that Gaighata Police Station Case No.995 of 2024 dated 02.11.2024 has already been registered for investigation under Section 85 of the BNSS. Except Debashish Mondal all the accused persons have

surrendered before the court and they have obtained bail.

In case the said accused persons do not appear before the court, the investigating agency would be at liberty to pray before the learned Magistrate for exhausting harsher process of law so that steps may be taken against the person who is evading the process of law.

With the aforesaid observations, WPA 9420 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
