Learned advocate appearing for the petitioner submits that the petitioner is in custody for seven months and other accused persons have been released on bail. Charge-sheet has already been submitted and the prosecution intends to rely upon 9 witnesses in order to prove its case. As such, petitioner prays for bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that recovery was made from the joint possession of the petitioner and others; other accused persons are absconding. I direct the learned Trial Court to take steps for exhausting the process of law in respect of the absconding accused persons. It has been informed that charge-sheet has

been submitted on March, 2026. Accordingly, within a period of sixty days from the next date fixed, the learned Trial Court would exhaust the process of law so far as the absconding accused persons are concerned and thereafter proceed towards consideration of the charges. Let whole of the process be completed by 15.08.2026.

At this stage, the prayer for bail of the petitioner is rejected.

Petitioner would be at liberty to approach this Court after the aforesaid time period is over.

The application for bail, being CRM (NDPS) 804 of 2026, is, thus, disposed of.

Learned advocate appearing for the State is directed to communicate this order to the learned Special Court at the earliest so that the learned Special Court can take steps on the date so fixed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
