The petitioner has filed the connected Matrimonial Suit No. 365 of 2012 for dissolution of her marriage with the opposite party by a decree of divorce.

The said suit is pending before the 5th Court of the learned Additional District Judge, Murshidabad at Berhampore.

The petitioner complains inordinate delay in disposal of the said suit.

Mr. Prantick Ghosh, learned advocate appearing on behalf of the petitioner submits that witness action from the side of the petitioner is complete and September 22, 2021 is the next date fixed for evidence of the husband/opposite party. He prays for directions upon the learned Trial Judge for immediate conclusion of the evidence of the husband/opposite party and expeditious disposal of the said suit.

Gourav Purakayastha, learned advocate appearing on the behalf of the husband/opposite party submits that his client shall co-operate for the expeditious disposal of the said suit.

The petitioner can legitimately expect a logical conclusion of the matrimonial suit filed by her in the year 2012.

The learned Trial Judge, therefore, is requested to dispose of the said suit expeditiously, preferably by the end of December, 2021, subject to availability of normal Court hours and to give effect to the said time limit for disposal of the said suit, the learned Trial Judge is further requested to conclude the evidence of the husband/opposite party on the next date fixed in the suit, however, in the event for any unavoidable reason, the said evidence cannot be concluded on the said date, it must be concluded within ten days thereafter.

The parties shall not be entitled to insist upon any unnecessary adjournment in the suit. C.O. 1136 of 2021 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
