NB 19.05.2022 CRR 1674 of 2022 Ct. No. 39 In the matter of:- Apratim Sen & Ors. ...petitioners Mr. Aneek Pandit, Mr. Pinaki Brata Ghosh, Ms. Sonakshi Mitra.

...for the petitioners.

This is an application seeking an expeditious disposal of a proceeding under the provisions of the Protection of Women From Domestic Violence Act.

Learned Counsel appearing on behalf of the petitioners submits as follows. The petitioners are the respondents in the proceeding before the learned Trial Court. The impugned proceeding was initiated by the private opposite party in the year 2018. In 2019, an order was passed directing the husband/petitioner to pay interim monetary relief in favour of the wife/opposite party and the child. However, thereafter, the matter has remained pending for no fault on the part of the present petitioners. In view of this, a direction may be passed to expedite the proceeding. I have heard the submissions of the learned counsels appearing on behalf of the petitioners and the State and have perused the revision petition.

No prejudice will be caused to anyone, if a direction is passed in respect of a prayer for expeditious disposal of the proceeding. It appears that the present case was instituted in the year 2018. Although, there is a statutory stipulation for an expeditious disposal of a proceeding as per the concerned Act, the proceeding could not be dealt with much expedition.

In view of the above and in the interest of justice, the learned Trial Court is requested to conclude the trial as expeditiously as possible without

granting any unnecessary adjournment to any of the parties. With these observations, the revisional application is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
