Mr. Raj Kumar Mr. Argha Das ...for the petitioner Mr. Sanjoy Bardhan Mr. Sourat Nandy ..for the State Learned counsel appearing on behalf of the petitioner submits that his client has been falsely implicated in a criminal case under Sections 406 and 420 of the Indian Penal Code because he defaulted in making payment of EMIs for a car that he was purchased from the SBI.

Learned counsel appearing on behalf of the State relies on the case diary and submits that the loan was taken in 2019 and the account was made NPA on 14.10.2021. On 29.03.2023, the car was repossessed and the present FIR was registered. Charge sheet has been submitted.

It will be for the Courts to decide finally whether, at all, a prima facie case is made out or not.

However, considering the nature of allegations and the materials available in the case diary, I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
