So far as the present status of the case is concerned, the investigating officer has put in efforts for tracing out one of the accused who according to the petitioner is the mastermind. Efforts have also been put in by the investigating officer of the case to search out the lady.
However, having considered the
complexity in this part of the further investigation, I direct the Superintendent of Police, Krishnanagar Police District to monitor this part of the further investigation so that the investigating agency may take the investigation to its logical conclusion.
Since two of the accused persons are in custody, the learned trial court, in seisin of the matter, would split up the trial by exhausting harsher process of law, thereafter, commit the case so that there may be commencement of the proceedings in respect of the accused persons who are in custody in connection with Tehatta P.S. Case No. 944 of 2023.
In case, there is other developments in course of the investigation, the Superintendent of Police will submit a report before the learned trial court which would be in seisin of the Sessions Case arising out of Tehatta P.S.
Case No. 944 of 2023.
With the aforesaid observations, WPA 9428 of 2025 is disposed of.
Pending connected application(s), if any, is also disposed of.
