Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 10 months and the case has already been committed to the court of sessions. Charges have been framed. Petitioner is similarly placed as the other accused Ali Hossain @ Md. Ali Hossain who has been granted bail. Learned advocate for the State has produced the case diary and drawn the attention of the Court to the statement of one Gulam Rosul.
Having considered the same, I am of the opinion that
petitioner is better placed than the other accused Ali Hossain @ Md. Ali Hossain who has been granted bail. Accordingly, the petitioner, namely, Diluwar Hossain @ Deluwar Hossain @ Dilwar @ Delwar Hossain be released on the same terms and conditions as was granted to Ali Hossain @ Md. Ali Hossain in CRM(M)177 of 2026. Thus, CRM(M)1006 of 2026 is allowed.
Memo of Evidence submitted by the State be kept with the record.
