Submission of learned counsel for petitioner is that the said Rajab Mondal was granted lease after the auction but he had failed to deposit the lease money, therefore he was blacklisted and now appropriate action must be taken against him.

Learned counsel for respondent Nos.2 and 7 appearing for the Nadia Zilla Parishad has informed that subsequently the amount was deposited by Rajab Mondal and the order of blacklisting was withdrawn and now he is free to take part in the open auction. On instruction, he has submitted that without the open auction no allotment of ferryghats will be done.

WPA(P) 217 of 2022 Considering the submission made by learned counsel for respondent Nos.2 and 7, we are of the opinion at this stage that no direction in the writ petition is required. Even otherwise the issue raised in the petition lies within the domain of the contractual transaction and administrative discretion of the competent authorities. No violation of any rules, regulations or any statutory provision in this regard has been pointed out. Hence, we do not find any reason to entertain the present petition which is accordingly dismissed. [Prakash Shrivastava, C.J.] [Rajarshi Bharadwaj, J.]
