The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such service of notice of the present revisional application upon the said opposite party is dispensed with.
The defendants in a suit for declaration are the petitioners of the present application under Article 227 of the Constitution of India and they are seeking a direction upon the learned trial Judge for expeditious disposal of the application filed by the plaintiff in the suit under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure.
Mr. Dipanjan Bhattacharya, learned advocate appearing on behalf of the petitioners submits that his clients are suffering an ad interim order of injunction, as such the said application for injunction is required to be heard expeditiously.
Mr. Bhattacharya submits that October 7, 2020, is the next date fixed for hearing of the said application. C.O. 1189 of 2020 is disposed of with a request to the learned Civil Judge, (Junior Division), Bidhan Nagar, North 24 Parganas to dispose of the application under Order XXXIX Rules 1 and 2 of the Code of Civil Procedure filed by the plaintiff/opposite party in Title Suit No. 27 of 2019 expeditiously.
The learned Trial Judge is requested to make all endeavour to commence the hearing of the said application on the date already fixed.
Needless to say the learned trial Judge shall not entertain prayer of the parties for any unnecessary adjournment.
CAN 1 of 2020 (old CAN no: 5971 of 2020) is disposed of accordingly.
No order as to costs.
