5.1.2024 C.R.R. 1017 of 2015 In the matter of: Bimal Kumar Bera & Ors.

ct.7,sl.3 This revisional application is pending since 27th March, 2015 and is running in the list since 5th June, 2023. None appears on behalf of the parties nor any accommodation is prayed for on their behalf, they were also not present on the previous occasions.

The parties were directed to ensure their appearance before this Court, otherwise necessary order was to be passed on the basis of the materials available on record.

Let this matter is taken up for passing order. This criminal revision is preferred by petitioners to quash the charge-sheet No.241 of 2014 dated 19th November, 2014 along with complaint of criminal proceeding against the petitioners arising out of FIR Sabong Police Station Case No. 157/2014 dated 18.8.2014 under Sections 447/448/427/34 of Indian Penal Code with 3(1)(v) of S.C. & S.T.(Prevention of Atrocities) Act, 1989 arising out GD Entry No. 2055 /2014. On a written complaint made under Section 156

(3) of Cr.P.C. to the learned Chief Judicial Magistrate, Paschim Medinipore, the Sabong Police Station Case No. 157/2014 under Sections 447/448/427/34 was started against the revisionist and after investigation; charge sheet was filed on 19th November, 2014 under the same

Sections as aforesaid. Apparently, I do not find any irregularity in the said charge-sheet which was filed after completion of investigation conducted by lawful authority in compliance of proper legal provisions.

It appears from the order dated 24th February, 2023 that petitioner nos. 2 and 7 died during the pendency of this proceeding and accordingly petitioners were directed to submit their death certificates which was necessary for passing appropriate order but no such certificate had been submitted by the parties. As such no order in this respect could have been passed. Considering the above facts and circumstances, the instant revision along with the pending applications are dismissed.

The interim order, if any, stands vacated.
