Mr. Saktipada Jana ......For the Petitioner Mr. Debasish Chattopadhyay ......For the State There were two contradictory reports - one by the Assistant Secretary to the Government of West Bengal and the other by the District Inspector of Schools. This court directed the Commissioner of School Education to hear this matter and to pass a reasoned order. The Commissioner of School Education has passed a reasoned order dated 23.12.2022 where it has been stated that the report submitted by the Assistant Secretary to the Government of West Bengal in the School Education Department which was submitted on 28.11.2022 is acceptable subject to the correction of the date of retirement of the petitioner. The date of retirement of the petitioner is 30th April, 2000 and not 30th April, 2013.

Therefore, this observation of the Commissioner is accepted by this court and the report in the form of an affidavit is kept on record. A copy of the report is to be handed over to the learned

advocate for the petitioner.

I direct the Director of Pension, Provident Fund and Group Insurance to take immediate steps for payment of arrear pension without any interest to the petitioner by four weeks from date of communication of this order.

The petitioner should supply a copy of this affidavit to the Director of Pension, Provident Fund and Group Insurance for his perusal. The petitioner is agreeable for non-payment of any interest in the arrear amount. That is why no order in respect of interest has been passed by this court.

With the above observation and direction this writ application is disposed of.
