The petitioner seeks transfer of investigation into an FIR being Barrackpore P.S. Case No. 25/2023 dated 10.02.2023 under Sections 302/201 of the IPC.

The investigation is on. The mobile phone of the deceased is in the process of being sent to the CFSL at Hyderabad upon receipt of request from Barrackpore P.S.

Let the evidence be despatched tomorrow (22.04.2023).

Upon receipt of the mobile phone, the CFSL, Hyderabad shall send their forensic report of the mobile phone to the Barrackpore Police Station, as expeditiously as possible, preferably within a month from date.

The Barrackpore Police Station shall send a list of queries to the CFSL, Hyderabad along with the mobile phone of the deceased.

6.

The investigation shall be completed as expeditiously as possible after receiving the CFSL report, preferably within a period of one month thereof.

7.

With the aforesaid observations, the instant writ petition shall stand disposed of.

8.

There shall be no order as to costs.

9.

The report of the Barrackpore Police Station, Barrackpore Commissionerate dated 21.04.2023 is kept with the record.

10.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
