1. Ms. Sumita Sarkar, learned advocate appears on behalf of the Union of India. Learned Advocate submits that no instructions have yet been received from the South Eastern Railways, despite repeated requests.

2. The prayer of the petitioner is innocuous. The petitioner seeks incorporation of a new bank account in the pension payment order upon deletion of the earlier account.

3. It is the specific contention of the petitioner that the petitioner holds a joint account with Smt. Kuheli Sanyal, his present wife. That upon demise of the petitioner, the family pension should be transmitted to Smt. Kuheli Sanyal. That the joint account in the name of the petitioner and Smt. Kuheli Sanyal should be incorporated, so that the pension can be received in the new account. The first marriage ended in a divorce.

4. The petitioner will hand over a photo copy of the decree of divorce with his first wife Smt. Syamali Gon to the Chief Personnel Officer, South Eastern Railways within 10 days from date and the authority, upon being satisfied that the marriage of the petitioner was annulled by the court of law, shall incorporate the new bank account in the pension payment order, so that the petitioner can receive pension in the said account on and from the month of October 2024, positively.

5. Accordingly, the writ petition stands disposed of.

6. All the parties are directed to act on the basis of the server copy of the order.
