1. The present writ petition has been filed, inter alia, challenging a show-cause and an order passed under Section 431(3) of the West Bengal Municipal Act, 1993 dated 16th December, 2025.

2. Records reveal that by notice dated 19th November, 2025 the Government was pleased to call upon the Board of Councilors of Purulia Municipality to show cause as to why the Board shall not be dissolved on the ground of the charges mentioned therein. The petitioners claim to have responded to the show cause.

According to the petitioners, without considering such response, an order under Section 431(2) of the said Act was passed. Following the above, by an order dated 16th December, 2025, the Principal Secretary, Government of West Bengal by powers conferred under sub-section (3) of Section 431 of the said Act had appointed an administrator.

3. This order also forms subject matter of challenge in the present petition. Unfortunately, the order based on which the Board of Councilors of the municipality

WPA 9780 of 2026 was dissolved has neither been disclosed nor the same has been challenged.

4. Having regard to the aforesaid, this Court is unable to appreciate the facts based on which the challenge is maintained. The petitioners cannot be permitted to simplicitor maintain a challenge against the consequential order.

5. In view thereof, the writ petition stands dismissed without any order as to costs.

6. Dismissal of the writ petition shall, however, not stand in the way of the petitioners from making an appropriate challenge to the order passed under Section 431 (2) of the said Act in accordance with law if so advised.
