Mondal @ Krishna Pada Mondal had expired on 18.01.2014 as reflected from a death certificate, which is tagged with the report. As the appellant has already expired, so the instant appeal stands abated.

The instant appeal be and the same is dismissed as abated. The appeal being CRA 327 of 2004 is disposed of. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court at once.
