Subhash Mehrotra & ORS. v. State Of West Bengal
01.10.2021 Ct No. 34 SL. No. 11 Somnath (PA)
IN THE HIGH COURT AT CALCUTTA
CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1440 of 2011 Subhas Mehrotra & Ors.
Versus
State of West Bengal Mr. Sanat Kr. Das, Mr. Sujan Chatterjee ...........for the petitioners. Mr. Binay Panda, Ms. Puspita Saha .........for the State.
The revisional application was preferred challenging the proceedings relating to Kulti Police Station Case No. 193 of 2009 dated 22.06.2009 under Section 498A/323/406 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
The revisional application was preferred at the stage when the Investigation Authority on conclusion of investigation submitted charge-sheet before the jurisdictional Court.
Records of the revisional application reflect that there has been no interim order since June 2012 and no
information could be furnished by the Learned Advocate for the petitioners before this Court regarding the present stage of the case in the Learned Court below.
Having regard to the fact that the petitioners approached this Court at a stage when the documents on which the prosecution proposed to rely were not served upon them, I am of the view that the revisional application was preferred at a prematured stage and as such no interference is called for.
Accordingly, CRR 1440 of 2011 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
