State of West Bengal & Ors.

The present revisional application was preferred challenging the order dated 04.04.2011 passed by the Learned Chief Judicial Magistrate, Purba Medinipore, refusing to refer the application under Section 156(3) of the Code of Criminal Procedure for being investigated by the Officer-in-Charge, Panskura Police Station.

The reasons so assigned in the order dated 04.04.2011 by the Learned Chief Judicial Magistrate, Purba Medinipore are that the allegations made in the application filed at the instance of the complainant required recording of evidence to ascertain whether any offence has been made out or not. As such the Learned Magistrate refused to send the same to the concerned Officer-in-Charge. The reasons so assigned in the background of the facts of the allegations

seem to be justified and as such no interference is called for at this belated stage.

Accordingly, CRR 1442 of 2011 is dismissed.

Pending application, if any, is consequently disposed of.

Interim order, if any, is hereby vacated.
