Madan Kumar Ghunti & ORS v. State Of West Bengal & ANR
01.10.2021 Ct No. 34 SL. No.14 Somnath (PA)
IN THE HIGH COURT AT CALCUTTA
CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE (Through Video Conference) CRR 1443 of 2011 Madan Kumar Ghunti & Ors.
Versus
State of West Bengal & Anr.
Ms. Aiswarjya Gupta ...........for the petitioners. Mr. Imran Ali, Ms. Debjani Sahu .........for the State.
The revisional application was preferred challenging the charge-sheet No. 419 of 2010 which was filed before the Learned Chief Judicial Magistrate, Howrah in connection with Jagacha Police Station Case No. 176 of 2006 dated 20.10.2006.
The revisional application was preferred at a stage when the documents under Section 207 of the Code of Criminal Procedure was not made available to the present petitioners and only the First Information Report and the charge-sheet was the foundation for challenging the proceedings before the Learned Chief Judicial Magistrate, Howrah.
I am of the view that the revisional application was preferred at a prematured stage, as such no interference is called for.
Accordingly, CRR 1443 of 2011 is dismissed.
Pending application, if any, is consequently disposed of.
Interim order, if any, is hereby vacated.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
