The learned Advocate for the petitioner submits that the petitioner is innocent of charges and has been falsely implicated in the instant case. He further submits that for the sake of investigation the custodial detention of the petitioner is unwarranted.

The learned Advocate for the State opposes the prayer for anticipatory bail and produces the injury report, which is present in the case diary.

We have perused the materials on record including the case diary as well as the injury report and on perusal of the same we are of the opinion that the petitioner may be extended the benefit of anticipatory bail.

Accordingly, we direct that in the event of arrest the petitioner, namely, Mihir Kumar Pradhan @ Mihir Pradhan, shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount, one of whom must be local, to the satisfaction of the arresting officer and

also subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. This application for anticipatory bail is, thus, allowed. (Tirthankar Ghosh, J.) (Harish Tandon, J.)
