02.05.2023 Sl. No.11(DL) srm W.P.A. No. 9260 of 2023 Debasish Acharya
Versus
The State of West Bengal & Ors.
Mr. Rajib Kumar Acharyya, Mr. Banshi Badan Maity ....for the Petitioner.
Mr. Pravur Kumar Ray ...for the State-respondents.
Despite service, none appears on behalf of the panchayat authorities. Affidavit-of-service is taken on record.
The petitioner submits that the case of the petitioner should be considered for grant of benefit under the Pradhan Mantri Awas Yojana (PMAY) or any other similar housing scheme.
The entire process for grant of benefits under the PMAY has come to an end and the scheme is no longer in operation. Hence, no orders can be passed.
If in future, a similar scheme is introduced either by the central government or the state government, the petitioner's eligibility shall be considered in accordance with law and strictly in accordance with the terms and
conditions of the scheme. As of now, no relief can be granted as neither the PMAY(G) nor AWAAS PLUS, are continuing.
This order shall not be construed as an opinion of the Court on the eligibility of the petitioner for grant of any benefit, under any housing scheme, in future. The writ petition is, thus, disposed of.
There shall be no order as to costs.
Parties are to act on the basis of the server copy of this order.
