Mr.Koustav Bagchi, ... for the petitioner Mr. P.K.Datta, APP Mr. Sanjoy Bardhan, Mr. Santanu Deb Roy ... for the State Learned Advocate for the petitioner submits that the petitioner is innocent of the charges and he has been falsely implicated in the case out of marital discord. Learned Advocate for the State produces the case diary. We have perused the materials on record including the observations made by the Doctor and having considered the same we are of the opinion that the custodial detention of the petitioner is not required for the sake of investigation of this case. As such the prayer for anticipatory bail is allowed.
In the event of arrest, the petitioner shall furnish bail bond of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties of like amount one of whom must be local to the satisfaction of the arresting officer of the case on condition that the petitioner shall not tamper with the evidence or intimidate the witnesses in any manner whatsoever.
The aforesaid order shall be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. The application for anticipatory bail being CRM 6326 of 2020 and CRAN 1 of 2020 are disposed of.
