1. Petitioner contends dispute is civil in nature. Coaccused-Prasenjit Ganguly has been enlarged on anticipatory bail. He prays for anticipatory bail.

2. Learned lawyer for the State contends investigation is still in progress.

3. We have considered the materials on record. Dispute relates to non-installation of elevator in the office of the de facto complainant. Co-accused, Prasenjit Ganguly, has been granted anticipatory bail. Petitioner is entitled to similar relief.

4. Accordingly, we direct that in the event of arrest the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section Signed By :

438(2) of the Code of Criminal Procedure, 1973 and on condition that he shall appear before jurisdictional Court and pray for regular bail within a period of four weeks from date and on further condition that he while on bail shall meet the Investigating Officer once a week until further orders.

5. The prayer for anticipatory bail of the petitioner is allowed.
