Learned advocate appearing for the petitioner submits that the petitioner was arrested on 28.08.2025 and since then he is in custody. There has been alleged recovery of 58.992 kgs of ganja. However, after submission of the charge-sheet there has been no progress in the case as another accused Nur Islam is in custody in connection with a case at Bhadrak, Orissa and although process has been issued against him but there is no production warrant which has been issued and only warrant of arrest has been issued against the said accused. Petitioner happens to be the owner of the car who has been implicated in the instant case. There being no possibility of the trial commencing learned advocate for the petitioner prays for bail.
On behalf of the learned advocate for the State the prayer
for bail of the petitioner has been opposed as commercial quantity of contraband has been issued.
I have taken into account the submissions of the learned advocates appearing for the petitioner as well as the State. The delay in this case is because of the other accused being in custody in connection with a case at Orissa. The learned trial court is directed to first assess regarding the submissions advanced on behalf of the petitioner in respect of the other accused,if required, production warrant of arrest be issued in connection with the instant case so that the instant proceeding can progress. Learned trial court would put in efforts so that the charges can be framed within a reasonable period of time. Petitioner would be at liberty to approach this Court after the seizure list witnesses are over. At this stage, the prayer for bail in CRM(NDPS)879 of 2026 is dismissed.
