Mr. Apurba Ghosh ........for the petitioner Mr. Saikat Chatterjee .....for the State The petitioner is the brother of a deceased lady farmer and claims certain amounts under the Krishak Bandhu Scheme floated by the State.

In the course of hearing, learned counsel appearing for the State places an order of the BDO, Borjora Development Block, Bankura stating that the petitioner is not eligible for the death benefit which is the subject matter of the present writ petition. The order is dated 1st December, 2021 but has not been communicated to the petitioner till date. The petitioner in the meantime was constrained to file the present writ petition in May, 2022.

Let the order be communicated to the petitioner in the course of today. Leave is given to the petitioner to withdraw the present writ petition and challenge the order if the petitioner is so advised.

The BDO, Borjora Development Block, Bankura shall pay costs of Rs. 20,000/- to Helpage India within

a fortnight from date for failing to communicate his order on the petitioner for almost one year.

WPA 8929 of 2022 is disposed of in terms of the above.

If the BDO is able to show that the order was communicated to the petitioner, the State respondents shall have liberty of mentioning the matter for appropriate orders.
