Sahira Bibi v. State Of West Bengal And ORS.
C.R.R.1415 of 2023 D/L69 07.03.2024 Bpg.
In Re: A petition under Section 401 read with 482 of the Code of Criminal Procedure, 1973;
Sahira Bibi
Versus
The State of West Bengal and others Mr. Maidul Islam Kayal Mr. Sumit Naskar.
...for the petitioner.
Petitioner has prayed for expediting the proceedings of A.C. Case No.2762 of 2011 which is under the provisions of Section 12 of the PWDV Act. The said proceedings are pending before the learned Judicial Magistrate, 2nd Court, Alipore, South 24 Parganas. Having considered that more than 13 years have passed and date has been fixed for evidence, I direct the learned trial court to fix a schedule once in every fortnight so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties and in spite of any resolution of local bar, the proceedings of the case would continue and the participating advocates will not in any manner stall the proceedings.
With the aforesaid observations, CRR 1415 of 2023 is disposed of.
Pending connected application, if any, is consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
