Per, Partha Sarathi Sen, J.:-

1. At the time of hearing, learned advocate appearing on behalf of the appellants has filed a letter dated 7th January, 2026, as written by the appellants to the learned advocate-on-record for the appellants stating, inter alia, that the present appellants are not willing to proceed with the instant appeal. It is submitted that in view of such letter an appropriate order may be passed in connection with the instant appeal.

2. Let the said letter be taken on record.

3. In view of the submission made by the learned advocate on behalf of the appellants, FMA 844 of 2025 is dismissed for non-prosecution.

4. With the dismissal of the instant appeal, CAN 1 of 2025 is also disposed of.
