Today the compliance reports have been filed by the alleged contemnors in the form of their respective affidavits, the same are taken on record. Copies are served upon the learned advocate appearing for the petitioner.
On perusal of the compliance reports it appears that upon considering the land records, the contemnor no. 2 has confirmed that the subject land is not a government land/public land and is a raiyati one. The report of the alleged contemnor no. 1 shows since, it is not a public land and is a raiyati one, they have got nothing to do with it.
Learned advocate appearing for the petitioner has challenged the correctness of the report. This is not within the domain of the contempt jurisdiction of this Court. So long the direction of the Court stands complied with, there shall be no act of contempt. The correctness or veracity of the reports cannot be gone into in contempt jurisdiction. In view of the above, this Court is satisfied that there is no act of contempt.
Accordingly, this contempt proceeding CPAN 668 of 2025 stands dropped and closed.
The application CPAN 668 of 2025 stands disposed of, without any order as to costs.
However, if the petitioner is aggrieved with the correctness of the reports and findings, they may avail of their appropriate legal remedy in accordance with law.
