Learned advocate appearing for the Malda District Central Cooperative Bank Limited submits that in the meantime the disciplinary proceeding has started and an Enquiry Officer has already been appointed. He files copy of the memo dated May 14, 2026 in support of such contention.
Since the disciplinary proceeding has already been initiated and an Enquiry Officer has been appointed, this Court feels that interest of justice
would be sub-served if the disciplinary proceeding is directed to be concluded within a stipulated timeframe.
Accordingly, this writ petition stands disposed of by directing the disciplinary authority to conclude the disciplinary proceeding as expeditiously as possible but positively within a period of three months from the date of receipt of a server copy of this order. It will be open to the petitioner to raise all points before such authority.
On a query of the Court, learned advocate appearing for the petitioner submits that the petitioner is in receipt of the subsistence allowance at the rate of 50% of the salary. He, however, submits that in terms of the service rules governing the service of the petitioner, petitioner is entitled to get enhanced rate of subsistence allowance.
It will be open to the petitioner to approach the appropriate authority for enhancement of the subsistence allowance and if such an application is made, the authority shall consider the same and pass necessary orders in accordance with law.
