The petitioner assails a notice dated January 22, 2021.

The State is represented.

By the impugned notice, demand under the West Bengal Public Demand Recovery Act, 1913 was issued to the petitioner.

Learned advocate appearing for the petitioner submits that, the petitioner is ready and willing to pay but by way of installments. She submits that, the bank account of the petitioner was attached.

Admittedly, amounts are due and payable by the petitioner. The petitioner is unable to substantiate that there is any lack of jurisdiction in the invocation of the Act of 1913. The Court is informed that the petitioner

is participating in the proceedings under the Act of 1913.

In such circumstances, the petitioner is at liberty to appear in the proceedings under the Act of 1913. He is also at liberty to raise such issues in the proceedings as he is entitled to in law. No interference is called for.

W.P.A. No.10384 of 2021 is disposed of, accordingly.
